The amendment to the Packaging Act came into force on July 3, 2021. On July 3, 2021, changes to the register information and the possibility of authorizing foreign companies without a branch in Germany will come into force.
The registration obligations for final distributors of service packaging and the extended registration obligation for obligated parties with details of all types of packaging that they place on the market will only apply from July 2022. What are new about the obligations from July 2022?
Register with types of packaging
Registration of all manufacturers of packaging in the LUCID packaging register with information on the types of packaging that they place on the market. The obligation to register will then no longer only apply to companies that hand over packaging that is subject to system participation but will also apply in the future to packaging that is not subject to system participation. Anyone who puts packaging on the market in accordance with Section 15 (1) of the Packaging Act, such as
- Transport packaging
- Sales and outer packaging that typically does not end up as waste for private end users after use
- Sales and outer packaging for which participation in the system is not possible due to system incompatibility according to Section 7 (5),
- Sales packaging for filling goods containing harmful substances
- Reusable packaging and
- One-way beverage packaging that is subject to a deposit in accordance with Section 31
Data reports on the packaging quantities
Data reports on the packaging quantities must continue to be submitted to the systems and in the packaging register exclusively for packaging that is subject to system participation in the same time rhythm in terms of content 1: 1.
Registration of final distributors
Registration of final distributors of service packaging in the packaging register, who have completely delegated the fulfillment of their obligations to a pre-distributor level. In the future, the “delegation” must also be confirmed in the register by clicking a checkbox.
Furthermore, producers and distributors of service packaging then must register in the packaging register and fulfill other obligations if the final distributor of service packaging has delegated the fulfillment of their obligations to them.
New extended responsibility for “electronic marketplaces / platforms and fulfillment service providers”
Operators of electronic marketplaces/platforms are only allowed to offer packaging that is subject to system participation for sale if the manufacturer has participated in the system and is registered in the German packaging register. Fulfillment service providers may only perform their activities for companies that have fulfilled their obligation to register in the German packaging register and their obligation to participate in the system.
